ACCOMMODATION
IMPORTANT: To protect all parties involved in the letting of your holiday property we ask that you carefully read the following Terms and Conditions. By making a booking and receiving a confirmation you agree to these Terms & Conditions.
You are confirming your acceptance of these Terms and Conditions by clicking the box when making your booking. Prior to receiving access to the property we must receive copies of both sides of the booking party’s current drivers licence.
EVEN MORE IMPORTANT: No more than the number of guests agreed and paid for in writing, may be on the property at any point in time without prior written permission. This means actually on the property at any point. This includes visitors and day trippers. This is extremely important and is now a requirement of the NSW Government Code of Conduct which has financial penalties for both guests and property owners. If extra guests/visitors are detected, then we may either ask the extra guests to leave OR evict the entire group at our discretion without refund OR charge $200 per extra guest for each night of the booking regardless of their unapproved length of stay. This may sound dramatic but because of previous actions of 2% of people doing the wrong thing, now the Department of Fair Trading require property owners to make this clause very specific.
CODE OF CONDUCT
New laws have come into effect from 18th December 2020 which we are required to inform you of.

In short the Code requires Guests to not at any time:
- Make noise that is unreasonably disruptive or interferes with the peace and comfort of neighbours or to act in a violent or threatening manner.
- Act in a manner that could reasonably cause alarm or distress to neighbours or others requested to come onsite by the host.
- Intentionally, recklessly or negligently damage the personal property of neighbours or other occupants.
- A guest must not copy, or knowingly retain, any keys at the end of the occupancy or provide the access code to anyone other than those confirmed as part of the booking.
The penalties are now in place and are quite harsh.
Guests who breach the above Code will be put on an Exclusion Register for 5 year which results in them being banned from being able to book any short term rental in NSW.
We are required to enforce the Code of Conduct and check this register prior to confirming any booking.
- Your holiday property is available from 3pm on your day of arrival with a vacate time of 10am on the date of your departure as shown on your booking confirmation.
- If not vacated by 10am an extra day will be charged for any late check outs unless agreed in writing otherwise. Any late departures will incur a min fee of $100 per hour or part thereof, which may increase to include cleaner costs if a cleaner has to charge waiting time. Early check in and late check out may be available in agreement in writing with the owner. A small fee of $100 will be charged for early check in or late check out. A guest registration form is required to be completed for all bookings.
- The registration form requests details of your name, address, and may also ask for drivers licence number as well as credit card details in some cases for some booking channels. We also require a cash bond to the value of at least $1000 to be payable. The bond balance will be returned within 14 days of your departure date. An increased bond may be incurred at our sole discretion. Failure to comply and abide by these Terms and Conditions can result in immediate revocation of the licence to Occupy without any refund of monies paid. Any bond issues attract a min $100 administration fee + costs.
If booked through Airbnb, VRBO or Booking.com we will not require Credit Card details to be provided to us as they hold this information.
- The premises are let to the person (21 or older) making the booking and that person will be held responsible for the conduct of all guests who all must be 21 or over unless expressly agreed to in writing. The premises are let for holiday purposes, only for the period stated on the Confirmation and for a maximum of 10 persons as agreed with the owner on this License to Occupy contract.
- The premises must be left in a clean and tidy condition, similar to that of arrival. Also when using a BBQ that it is left in a clean and tidy state otherwise a minimum additional cleaning fee of $100.00 will be charged.
- All the properties are Strictly NON-SMOKING and heavy Bond Breach penalties apply for evidence of smoking.
- A 50% deposit is required for all bookings. Balance of tariff is due thirty (30) days prior to your arrival date. If booked through Airbnb, VRBO and Booking.com they will advise you regarding any specific requirements as they handle your funds.
CANCELLATION/REFUND POLICY
- Reservations cancelled more than 30 days in advance of the booked dates will receive a full refund. If you cancel within the 30 days you will forfeit all monies paid unless another reservation is taken duirng the same period.
- Cancellation requests must be made in writing.
- In the event that the property is unable to be be relet for the same dates and no less than the same rate, then any monies paid up until the time of cancellation will be forfeited.
- We retain the right to negotiate the tariff or length of stay to obtain a new booking on a cancelled booking as we deem necessary. Should a booking be taken for part of the original dates, or that there is a shortfall in the new booking amount, then the guest will be responsible for the shortfall to ensure we are not left out of pocket.
- If a guest shortens their stay or reduces guest numbers the unused portion of your rental is not refundable.
- We recommend domestic travel insurance for anyone who may feel that the booking dates could be at risk. If booked through Airbnb, VRBO or Booking.com they will have their own cancellation policies.
- Our holiday property is equipped for a maximum of 8-10 guests (including the extra studio room) only and your confirmation will clearly state the number that you have booked. It is against Health Department regulations for more persons to occupy a property that there are beds to accommodate them. No extra mattresses, bedding, tents or caravans are allowed. If a property is reported to be overloaded, the tenants will be asked to vacate with no refund made.
- Linen, towelling and toiletries are provided, please bring your own pool towels. All linen and towels are laundered offsite, please do not strip beds or wash any of the linen or towels. This service is already included in your fee.
- Under NO circumstances are Pets allowed on any holiday property unless previously stated, noted on your booking form and rules agreed to in writing.
- Tenants are responsible for safekeeping of accommodation keys which are not allowed to leave the property under any circumstances. A digital code is provided for the front door during your stay. If keys are lost you will be responsible for all costs of changing the locks. Note the one key is used for all window locks. Should a guest require extra keys after hours a service fee at cost is applicable. If no keys are available, tenants will be liable for any costs involved in gaining entry to premises through any access point.
- All guests are responsible for any loss or damage arising from breakages or other damage to the property during their stay, including but not limited to any additional cleaning, removal of excess garbage, repairs or replacement items in the property. Please respect our property and under no circumstances should furniture be moved including dragging across floors. A fee may be charged should this occur. All damage, breakages or losses to the property and/or furniture and furnishings are to be reported to the host within 24 hours and paid for by the guest immediately. Should you discover a fault or breakage when you arrive, please advise us or we will consider those the responsibility of the current guest and charge accordingly. Funds will be deducted from the security deposit if we need to make a claim which may include, but is not limited to, the following: excess cleaning fees, damage or breakage, excess garbage removal, excess guests, excess noise, disruption to neighbours/neighbour amenity, unauthorised late checkout. Under no circumstances should furniture be moved.
- All guests are responsible for keeping the property secure during their stay and guests will be responsible for any theft or damage due to neglect in this area.
- No liability is accepted for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by events beyond the agent or owners control. No responsibility is taken for guests’ personal property left on or near the premises. It is recommended that guests take out personal property insurance or adequate travel insurance should any unexpected situations arise before or during your travel period.
- No responsibility is taken for tenants personal property left on the premises. If requested we will endeavour to recover and return items of value inadvertently left in your holiday property, but take absolutely no responsibility for the recovery or return. Postage, packaging and the cost of sending out a staff member to search for the item will need to be paid in advance; a minimum cost of $25 applies. Items of low value will be disposed of within 14 days.
- All laws must be observed, you are in a residential area and regard must be paid to the quiet enjoyment of other neighbouring properties, noise pollution is a punishable offence by law and as such we reserve the right to immediately terminate the license to occupy the property and/or lose not less than 100% of bond for any breach of this condition.
- The booking is made in good faith by us but may be subject to change, alteration or cancellation at any
time and at our sole discretion. We cannot accept responsibility for events out of our control. - In the case of refurbishment, owner instructions or special event announcements, rental rates may be subject to increase without notice. Should this occur you will be notified and given the opportunity to pay
the difference in tariff or receive a full refund of your deposit. - Milla’s Vineyard Estate is privately owned and rented on a fully self contained basis. In the event of faults and/or malfunctions of appliances or inclusions there is no obligation from the owner to compensate or discount.
- At times situations arise of which we have no control. If upon arrival the property is not habitable due to a complete lack of water or power for an extended time your accommodation will be fully refunded less any transaction fees incurred by external credit card providers
- Your booking request is confirmed only once you have completed the following:
- Completed booking form listing the total number of all adult and children guests, agreement to all Terms and Conditions via ticking the check box on the booking form
- Clear copies of both sides of the booker’s drivers license
- 50% deposit, or full balance if check in date is less than 15 days away
- Agreement to pay security deposit due to be made with final payment is implied with you agreeing to these terms and conditions.
- The tenant agrees to allow the Agent or his nominee to enter accommodation to arrange necessary repairs.
- Should a Tradesperson/Agent be sent out upon your request to carry out a repair that was deemed by us to be unnecessary, the cost of the callout will be charged to you.
- In the event of a call out after hours to our agent a min $100 call out fee applies.
- In the event of renovation/building work being carried out in or near the holiday premises, such work is beyond our control and we cannot accept responsibility for any disturbance, noise or inconvenience you may suffer as a result. No discount will be negotiated for any of the above.
- Tariffs are subject to change without notice.
- Garbage Bins are provided with all properties. Please ensure that all garbage is removed from your holiday property and placed in bins provided.
- The host reserves the right to withhold funds from the Holding Security Deposit (including via any agreed Credit Card pre Authorisation) as a security deposit in the event of any loss or expenses arising from a breach of this agreement, not limited to extra costs incurred for repairs, cleaning and excessive rubbish removal. Where credit card details are requested these credit card details will be deleted at the end of the month in which the booking occurred.
- No pets allowed.
- The guest responsible for the booking must register with Milla’s Vineyard Estate by phone or SMS at least 24 hours before check in. The guest will then be given the property access code.

This website is owned and managed by Milla’s Vineyard Estate. By accessing or using this website you agree to be bound by these terms and conditions of use as amended from time to time. If you do not agree to these terms and conditions, you may not use Milla’s Vineyard Estate website.

These terms and conditions are governed by the law of New South Wales, Australia. Disputes arising from these conditions are in the first instance exclusively subject to the jurisdiction of the courts of New South Wales, Australia.
WINE SALES
Under Australian laws, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over. By placing an order with Milla’s Vineyard Estate you are confirming to us that you are at least 18 years of age. It is an offence to sell or supply to or obtain liquor on behalf of a person under the age of 18 years. We also recommend that alcohol should only be consumed in moderation.
As we use Australia Post for our deliveries we have been guaranteed if a bottle is broken in transportation the whole case will be returned to Milla’s Vineyard Estate. If you receive a case of wine with a broken bottle (s), please let us know within two working days of the date of delivery. Upon follow up with Australian Post we will issue a credit note for the broken bottle.
Wine returns have to be mutually agreed by the purchaser and Milla’s Vineyard Estate. The purchaser is liable to keep the wine in a safe and proper manner and take reasonable care of it. The wine should be packed to avoid breakage in transit for its return back to Milla’s Vineyard Estate. No refunds are offered for products that are lost or damaged after delivery.
